Possible Challenge on 1/6?
Hello all! Looking for clarification on what to expect in 1/6/21.
So the way I understand it, on the 6th, Congress will meet to certify the results of the Electoral College vote. VP Pence will open and tally the votes, and has no authority to challenge their validity or to reject them in favor of any “alternate” slate of electors.
Some members of the House of Rep’s say that they will challenge the acceptance of the electors’ votes. This would require them to find a Senator to go along and force a vote in Congress. Then both chambers would spend two hours debating separately and hold a vote that would require majority support in both chambers to pass.
Where I get a little hazy is what a MAJORITY looks like in this situation, especially for the House of Rep’s. There seems to be a concensus that since the Democrats have a majority in the House, this challenge will almost certainly fail. However, there seems to be a dissenting opinion that the vote in the House will be 1 vote per delegation, per state, NOT per House member. The same source also claims Republican delegation votes outnumber Democrats’ 3 to 2, thereby giving Trump a chance to gain enough support in both chambers to successfully overturn the election.
Disclaimer: I do NOT support Trump’s unproven claims of voter fraud. I am only interested in clarifying this procedural step.
